Responses to Bid Questions
Q1: Will the City be paying the $36,460.00 railroad license fee or will that be the responsibility of the contractor?
Response: The City is responsible for the $36,460.00 license fee referenced in Article 2 of the Railroad Pipeline Crossing Agreement (Appendix B).
Q2: Will the City be paying the $1,500.00 railroad license administrative handling fee or will that be the responsibility of the contractor?
Response: The City is responsible for the $1,500.00 fee referenced in Article 5 of the Railroad Pipeline Crossing Agreement (Appendix B).
Q3: Will the City complete the RailPros Project and Billing form for the railroad flaggers and construction observers?
Response: The City has completed and submitted the Project and Billing form referenced in the RailPros instruction email in Appendix D. Per section 1-07.28 of the Special Provisions, the City will pay for these services for up to 15 consecutive working days. If additional railroad flagging and/or construction observation (inspection) days are required in excess of those 15 days, this cost will be borne by the Contractor at rates established by RailPros (see attached rates).
Q4: The contractor will need time to complete the railroad Work Plan (Appendix D), railroad safety training and order pipe materials prior to the proposed start date of April 28, 2025. When does the City plan to award this construction contract?
Response: The City plans to recommend the award of the construction contract for the lowest qualified bidder to City Council on March 18, 2025, and subsequently issue a notice of award on March 19, 2025.
Q5: General Note 19 on sheet 1/5 states that staking will be placed by the engineer prior to trenching. However, the special provisions discuss contractor surveying and includes measurement and payment for Construction Surveying. Please clarify who is responsible for construction staking.
Response: The Contractor is responsible for all construction surveying and staking per Section 1- 05 of the Special Provisions. The note on the plan sheet will be corrected in a future addendum.
Observation Rates:
The daily rates for said services to be provided under this Agreement are based on eight (8) hours per day and will be asfollows:
• Mobilization/Administrative Fee………….$1,000 per Observer Required (each project number(s) will incur a fee for travel and administrative costs per Observer). 24 Hour continuous work requires two Observers. Project must be cancelled 4 business days prior to the scheduled start date to avoid additional mobilization fee. Cancellations and release of field staff must be made in writing to Utilities.Office.Staff@railpros.com. Multiple mobilization fees or additional labor fees will be charged if the project cannot be constructed in consecutive days (Monday through Saturday is considered a work week) or if there is any delay during installation.
• Construction Observation Fees……………$1,400/Standard 8-hour day. Overtime rate after 8 hours is $200 per hour (all scheduling requests require a minimum 10-business days’ notification).
• Surcharge Fee………………………………………Activity in certain regions of the U.S. has created high demand for hotel rooms and increased related travel costs. The Project falls within such a region, therefore a surcharge of $300.00 per day will be added to the invoice.

Flagging Rates:
The rates for our services are as follows for work performed on, over or under Union Pacific ROW:

In the event of cancellation, if RailPros Management is given less than 24 hours' notice, it is considered a billable day.

This quote is based on RailPros standard labor rates and does not take into any account prevailing wage requirements. If prevailing wages are appliable for this project, RailPros will re-quote based on the prevailing wage requirements.
Invoices are submitted upon completion of the job or at month's end. On-going jobs are billed on a monthly basis. Payments of invoices are due upon receipt. The quoted rates are valid for 30 days and is subject to the Services Agreement (SA).
